Acceptance of Terms

By accessing and using iPayu ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of iPayu operated by iPayu Technologies Private Limited ("we," "our," or "us"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

Service Description

iPayu is a payment platform that enables businesses and individuals to:

Create custom payment forms and pages
Accept payments through various methods including credit cards, debit cards, UPI, and net banking
Manage and track payment transactions
Generate payment links and QR codes
Access analytics and reporting features

Note: iPayu is not a bank and does not provide banking services. We facilitate payment processing through licensed payment gateways and financial institutions.

Eligibility

To use iPayu, you must:

Be at least 18 years old and legally capable of entering into contracts
Have the authority to bind any business or entity on whose behalf you use the Service
Provide accurate, complete, and current information during registration
Maintain and promptly update your account information
Comply with all applicable laws and regulations in your jurisdiction

We reserve the right to verify your eligibility and may request additional documentation to confirm your identity and business legitimacy.

Account Responsibilities

Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Immediately notifying us of any unauthorized use
Using strong passwords and enabling two-factor authentication when available

Business Information

You must provide and maintain accurate business information including:

Legal business name and structure
Business address and contact information
Tax identification numbers
Banking and financial information
Authorized representatives and signatories

Fees & Payments

Platform Fees

iPayu charges a platform fee for facilitating payment processing services. The exact fee structure may vary based on your business type, transaction volume, and selected service package.

Platform fees are charged as a percentage of the transaction amount plus a fixed fee per transaction.
The fees are subject to change with prior notice as per the agreement.
Actual payment gateway charges (e.g., from banks, UPI providers, wallets) are passed through as applicable and may vary.
Settlement cycles and processing times depend on the payment gateway and transaction type.

Note: iPayu acts as a payment facilitator and does not hold funds or provide banking services directly. All gateway charges and fees are governed by respective payment providers and may change periodically.

Acceptable Use

You may use iPayu only for lawful purposes and in accordance with these Terms. You agree to use the Service responsibly and not to:

Refunds & Cancellation

We strive to provide a transparent refund and cancellation process. Please review the key points below to understand your rights and responsibilities.

Key Points:

Account cancellation requires a 30-day prior written notice.
Refunds are subject to the policies of the underlying merchant and financial institutions.
Platform service fees are non-refundable except in cases of error or fraud.
Refund processing typically takes 5-7 business days once approved.
We encourage timely communication to resolve any payment disputes.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

iPayu shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total aggregate liability shall not exceed the total fees paid by you to us in the twelve (12) months prior to the claim.
We are not liable for failures or disruptions caused by third-party payment gateways or financial institutions.
You acknowledge that payment processing involves inherent risk and agree to assume such risks.

Important: Some jurisdictions do not allow limitations of liability for certain damages. In such cases, the above limitations may not apply to you.

Termination

Termination by You

You may terminate your iPayu account at any time by providing 30 days written notice. Upon termination:

All pending transaction processing will be completed.
Final settlement payments will be made within 7 business days.
Your data will be handled in accordance with our Privacy Policy.
You remain responsible for any accrued fees and obligations.

Termination by iPayu

iPayu reserves the right to terminate your account immediately for reasons including but not limited to:

Violation of these Terms of Service
Fraudulent or illegal activities
Excessive chargeback or dispute ratios
Failure to comply with applicable regulatory requirements

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision will be limited or eliminated to the minimum extent necessary, so that these Terms will otherwise remain in full force and effect.
